Frequently Asked Questions

Clear answers to common questions about the mediation process.

The agreement reached in mediation, called a Memorandum of Understanding, is not legally binding on its own. However, it can easily be made legally binding by a solicitor through a 'consent order.' This is a simple, low-cost process once you have an agreement.

Mediation is a voluntary process. However, you are generally required to attempt it before going to court. After your individual MIAM session, if your partner declines the invitation or the mediator deems the case unsuitable, we will issue you the necessary certificate to proceed with a court application.

On average, most couples complete the mediation process within 2-3 sessions over a period of 4-8 weeks. This is significantly faster than the court process, which can often take over a year.
